Evidence by design

How to make your product generate evidence that holds up in court

Your product's data can be used in a US court if it is authentic, unaltered, time-stamped and backed by a documented chain of custody. Build those four properties into the product from day one, and your logs, records and AI decisions become admissible digital evidence — and a sales advantage.

What US courts look for

Authenticity — FRE 901

Proof the record is what you say it is and came from your system.

Self-authentication — FRE 902(13)/(14)

System-generated records and hash-verified copies certified by a qualified person.

Integrity & chain of custody

Evidence nothing changed between capture and courtroom.

Reliable methodology — FRE 702

A process an expert can explain and defend under Daubert.

Forensic readiness checklist for startups

  1. 1. Tamper-evident logs

Append-only storage with cryptographic hash chaining so any change is detectable.

  2. 2. Hash every artifact

SHA-256 at capture time, stored separately from the data it protects.

  3. 3. Trusted timestamps

Synchronized clocks plus RFC 3161 or equivalent trusted time-stamping.

  4. 4. Identity of the source

Record who or what created each event: user, device, system, model version.

  5. 5. Chain of custody

Log every access, copy, export and transfer of evidence-relevant data.

  6. 6. Retention and legal hold

Documented retention rules and the ability to freeze data when litigation is expected.

  7. 7. Forensic export

One-click export with hashes, metadata and a custody report a third party can verify.

  8. 8. Self-authentication ready

Output designed for a qualified-person certification under FRE 902(13)/(14).

  9. 9. Documented methodology

Written, repeatable process an expert can explain and defend (Daubert / FRE 702).

  10. 10. AI decision records

For AI products: inputs, prompts, model version and output saved as a verifiable receipt.

Frequently asked questions

Can data generated by my software be used as evidence in a US court?

Yes. US courts accept electronically stored information when it is relevant and authenticated. Under Federal Rules of Evidence 901 and 902(13)/(14), records generated by a reliable system and verified by hash values can even be self-authenticating with a qualified person's certification.

What makes digital evidence admissible?

Relevance, authenticity (proof it is what it claims to be), integrity (it was not altered), a documented chain of custody and, where expert analysis is used, a reliable and explainable methodology under FRE 702.

What is forensic readiness for a startup?

Forensic readiness means designing your product so that, when an incident or dispute happens, the data you need already exists, is trustworthy and can be exported in a verifiable form — without an expensive after-the-fact investigation.

Why does this matter for selling in the US?

US enterprise, insurance and government buyers increasingly ask vendors to prove what happened. Evidence-grade output is a differentiator competitors cannot copy with features alone, and it shortens legal and procurement reviews.

How does Cybertech Acceleration help?
